معناشناسی حقوقی گستره مفهومی «میراث مشترک بشریت» در اسناد بین‌المللی و دلالت های حقوق فرهنگی آن

چکیده
میراث مشترک بشریت، به‌عنوان مفهومی در جهت حمایت از حقوق بشر و ارزش‌های والای انسانی مطرح شده است و در ادبیات حقوق بشر، در درون حقوق همبستگی یا حقوق جمعی بحث می‌شود. این مفهوم در اسناد بین‌المللی مختلف، شامل کنوانسیون‌ها و اعلامیه‌ها؛ از جمله، اسناد مربوط به حقوق دریاها، فضای ماورای جو، حقوق بین‌الملل محیط‌زیست، تنوع فرهنگی، ژنوم انسانی و نظایر آن مورداشاره و تعریف قرار گرفته است. علی‌رغم استقرار این اصل در اسناد بین‌المللی همچنان ابهامات و اختلافات عمیقی پیرامون مفهوم، محتوا، حدود و کاربست عملی آن وجود دارد. در این مقاله تلاش شده است تا با بررسی متون و اسناد حقوقی بین‌المللی که شامل اشاراتی به مفهوم میراث مشترک بشریت داشته‌اند، به تبیین قلمرو مفهومی موردنظر پرداخته و عناصر میراث مشترک بشریت را در حوزه‌های مختلف حقوق بررسی نماید. پرسش اساسی این مقاله این است که مفهوم «میراث مشترک بشریت» در متون و اسناد حقوقی بین‌المللی با چه گستره مفهومی و مصداقی مطرح و توسعه‌یافته است؟ فرض اساسی این مقاله بر این مبنا استوار است که در متون و اسناد و حوزه‌های مختلف حقوق بین‌المللی قلمرو و برداشت مفهومی تقریباً یکسانی از مفهوم میراث مشترک بشریت ارائه شده است.

چکیده English

The common heritage of humanity has been proposed as a concept to protect human rights and high human values, and in human rights literature, it is discussed within the rights of solidarity or collective rights. This concept has been mentioned and defined in various international documents, including conventions and declarations; including documents related to the law of the seas, outer space, international environmental law, cultural diversity, the human genome, and the like. Despite the establishment of this principle in international documents, there are still ambiguities and deep disagreements about its content, limits, and practical application. This article attempts to explain the conceptual scope in question by examining international legal texts and documents that have included references to the concept of common heritage of humanity and examine the elements of common heritage of humanity in different areas of law. The basic question of this article is: to what extent has the concept of "common heritage of humanity" been proposed and developed in international legal texts and documents? The basic assumption of this article is based on the fact that in various texts and documents and areas of international law, the conceptual scope and understanding of the concept of common heritage of humanity are presented in almost the same way.
