Supporting the creators of software and religious works is considered a way to develop and propagate Islamic culture. One of the important aspects in this field is the basis for supporting the creator. Various arguments have been put forward regarding the support of the creator of a work, such as the rule of Masalih Mursalah (consideration of public interest), the value of the creator’s rights, the authority of the jurist and governmental decree, rational underpinnings, the judgment of reason, inherent ownership of humans over their own work and achievements, the principle of no harm, the prohibition of usurpation and theft, fulfillment of contracts, and the principle of system preservation. Contractual support is also addressed in this context. From examining the arguments of both proponents and opponents of software creator rights, it is concluded that these rights can be considered valid. The argument that can support this is the rational underpinning, especially according to the theory that does not require the endorsement and connection to the time of the Infallible (peace be upon him) or considers a general endorsement sufficient. Although each of the other arguments in favor of the creator’s rights faces one or more objections, they can still serve as supportive evidence for the creator. Contractual support for the creator may be referenced, which could relate to the production or transfer of software.
