Cultural criminology of filicide in Islamic jurisprudence and Iran's criminal law examines the social, cultural, and religious factors influencing this phenomenon. In Iran's legal system, based on Imami jurisprudence, a father who kills his child is exempt from qisas (retaliatory punishment) , whereas a mother does not receive this exemption. This disparity in punishment is rooted in jurisprudential teachings that emphasize the father's role in child-rearing and guardianship. From a cultural criminology perspective, filicide is influenced by various factors, including economic pressures, family conflicts, traditional beliefs, and inadequate protective laws. Some studies indicate that the rising rates of filicide in Iran and other Islamic countries adhering to this criminal policy highlight the need for revising relevant criminal laws. This article, adopting a comparative approach between the jurisprudence of the five Islamic schools and Iran's criminal law, analyzes the perspectives of jurists and legal scholars and offers suggestions for legal reform and reducing this crime.
